NSG Social Network Restriction with local mental health agency ruled unconstitutionalOctober 31, 2009 - FOR IMMEDIATE RELEASE
MARION, IN - NO SIR GIFTS Venues. (NSG), a local gift retailer and
television media conglomerate, announced today that The Indiana Civil
Rights Commission (ICRC) has informed NSG that they have ruled two
Social Media Policy restrictions as unconstitutional. The
unconstitutional ruling occured after several hundered customers of NSG
and clients of a local mental health agency have complained to ICRC
that employees of NSG couldn't be Facebook and MySpace friends
with employees of mental health agency Grant Blackford Mental
Health (GBMHI), which violates the Indiana Constitution (Atricle 1,
Sections 3, 9, and 11 and Article 9) and Indiana Code 35-46-2-1. Under
Article 9 of the Indiana Constitution, NO SIR GIFTS
knowingly denied current employees of GBMHI the full use of NO SIR
GIFTS'MySpace and Facebook pages to the general public. In April 2009, NSG announced that it had reached agreements with Facebook, MySpace and Twitter for the promotional purposes for NO SIR GIFTS Customers who purchase gifts and receive media for all NO SIR GIFTS customers. NSG also reached an agreement with (GBMHI) for the representative payee agreement of NO SIR GIFTS Customers who purchase gifts and receive media for its Marion and Gas City Bright House Networks customers who lost Fort Wayne Television, in addition to Indianapolis Television last December. Notwithstanding the action of the ICRC, NSG believed that its Social Network Policy would not have violated any laws. This situation, however, is unique because of the unilateral power held by the ICRC under the Indiana Constitution. In this particular case, however, it appears that NSG employeees and customers can now become Facebook and/or MySpace friends with GBMHI employees and clients. NSG is fully cooperating with ICRC and all available legal resources. “NO SIR GIFTS will be more than happy to donate Social Media Services as part of these new developments with GBMHI,” said NO SIR GIFTS’s President and Chief Executive Officer Aeverine Nieves. “This ruling by the ICRC, will probably pave the way for NO SIR GIFTS and GBMHI customers, clients, and employees, as well as other services that NO SIR GIFTS and GBMHI have been offering for nearly 23 years. NO SIR GIFTS would like to take the time to apoloigize to GBMHI clients and employees for any incinvience this may have caused.” NO SIR GIFTS began a partnership with GBMHI in July 1987.
